These Terms & Conditions apply to your access to pollnews.in, Polltech’s public websites, and the publicly available features of our web and mobile applications (together, the “Services”). By accessing or using the Services, you agree to these terms. Separate written agreements, order forms, or project instructions govern paid and client-specific services; if they conflict with these terms, the signed agreement controls for that engagement.
1. About Polltech
The Services are operated by Polltech Management Consulting Pvt. Ltd. (“Polltech”, “we”, “us”). Our contact details are listed below. The Services provide information about our consulting, research, campaign coordination, and election technology offerings.
2. Permitted use
You may use the Services only for lawful purposes and in accordance with these terms. You must not attempt to gain unauthorised access, disrupt or probe systems, bypass security, introduce malicious code, scrape or copy data at scale, misuse another person’s account, or use the Services to harass, deceive, unlawfully profile, or violate another person’s rights.
3. Accounts and authorised tools
Some application features are available only to users authorised by Polltech or a client. You are responsible for keeping credentials secure, using only your assigned access, and promptly reporting suspected compromise. You must use project data and tools only for the task and organisation for which access was granted, follow client instructions, and not export, disclose, or reuse data without authorisation.
4. Election and campaign data
Users must ensure that any personal data, voter information, survey responses, information or materials they submit or upload were obtained and may be used lawfully. Use the Services in compliance with applicable election, privacy, telecommunications, and other laws, and respect the rights and choices of individuals. Polltech may restrict access or remove material when reasonably necessary to protect people, clients, or the Services.
5. Content and intellectual property
Unless indicated otherwise, the Services and their software, design, text, graphics, and branding are owned by or licensed to Polltech and are protected by applicable intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable right to use the public-facing Services for their intended purpose. You retain rights in material you submit, but grant Polltech permission to host and process it to provide the Services and fulfil the relevant project. Do not upload confidential or personal information into a public demo or enquiry form unless requested and authorised.
6. Demonstrations and information
Demonstrations, sample dashboards, sample figures, and general website content are illustrative and may not reflect live election information or guarantee a particular result. You are responsible for evaluating information and obtaining appropriate professional advice before relying on it. Polltech does not guarantee uninterrupted or error-free availability of public website features.
7. Third-party services and links
Features may rely on third-party hosting, mapping, messaging, app stores, or other services. Those services may have separate terms and privacy policies. Polltech is not responsible for services operated independently by third parties.
8. Suspension and termination
We may suspend or limit access where we reasonably believe these terms have been breached, access presents a security or legal risk, or a client engagement ends. You may stop using the public Services at any time. Any continuing obligations under a separate client agreement remain governed by that agreement.
9. Disclaimers and liability
To the extent permitted by applicable law, the public Services are provided on an “as available” basis, without warranties that cannot legally be excluded. Nothing in these terms excludes liability that cannot be excluded under law. For any liability that may lawfully be limited, Polltech will not be liable for indirect or consequential loss arising from use of the public Services. Any limits in a signed client agreement apply to that engagement.
10. Changes and governing law
We may revise these terms by posting an updated version with a new effective date. Continued use after the update takes effect constitutes acceptance to the extent permitted by law. These terms are governed by the laws of India, and courts with jurisdiction in Lucknow, Uttar Pradesh will have jurisdiction, subject to mandatory legal requirements and any dispute resolution clause in a signed agreement.
